The Site constitutes a platform intended for the discovery, sale and online purchase of products improving your sleep (hereinafter, the “Service”).

Any questions or complaints relating to the Site, to these general conditions of use (hereinafter, the "GCU"), to the general conditions of sale (hereinafter, "GTC"), to the privacy charter (hereinafter, , the “Charter”) and the policy relating to cookies (hereinafter, the “Cookie Policy”) can be sent to HIBOO sprl at the address mentioned above or to the following email address: hello@hiboo.com .

Hiboo 2: Acceptance of the general conditions of sale

Access to the Site is subject to these T&Cs, the Charter, the Cookie Policy and applicable laws and regulations. Consequently, access to the Site implies full and unreserved acceptance by the user (hereinafter, "the User") of these T&Cs, the Charter and the Cookie Policy.

These T&Cs, the T&Cs, the Cookie Policy and the Charter exclusively govern the relationship between the User and HIBOO sprl relating to the use of the Site and the Service. They can be consulted at any time on the Site.

Hiboo 3: Validity of the offer

The products sold by the Hiboo company are intended for consumers with a delivery address in Belgium for free delivery and in Europe for a transport quote request. The items are sold within the limit of available stocks to customers meeting this geographical criterion.

The products sold by Hiboo are intended exclusively for individuals and the resale of items purchased on the site www.hiboo.be is prohibited.

In the event of collection of an order for which a product is unavailable at the time of delivery, the Hiboo company undertakes to notify the customer and offer them a new delivery date as quickly as possible or a refund within a maximum of 2 days after the request to cancel the order.

Hiboo 4: Price

The prices indicated on the website www.hiboo.be are indicated in euros, including VAT (All Taxes Included).

Prices include the environmental contribution of €17. In force since 01/01/21, it is used to cover the costs of collecting, processing and dismantling used mattresses.

If the VAT rate in force were to be modified, the prices of the items could be modified accordingly, without the customer being informed in advance.

Hiboo reserves the right to modify its prices without notice and at any time. Billing is done at the rate in effect at the time of registration and acceptance of the order.

The products remain the property of Hiboo until full payment of the order. This price is payable in full and in a maximum of two installments: a deposit followed by payment of the balance (except for specific payment arrangements in several installments).

Hiboo reserves the right to cancel or not validate an order for which the payment of this order or a previous order of the customer presents a dispute.

Actions, promotions and sales cannot be combined.

In the case of delivery outside the European Union or in the French Overseas Territories, you are considered the official importer and required to comply with the regulations of the country where the goods are received. Any taxes and customs duties that are due when the package arrives at its destination are the responsibility of the customer. We are not required to provide you with the amount of these duties and taxes due.

Hiboo 5: Confirmation and Order Management

Hiboo undertakes to confirm each order placed by sending an email. This email confirms that the order has been taken into account and that the amount of the order has been debited. After sending the order confirmation email, Hiboo cannot guarantee that the customer will be able to cancel the order.

If you need to make a modification or cancellation, we invite you to contact us within 48 working hours. The order will not be modifiable once the product is in production. Any modification to an order is subject to a price re-evaluation.

Hiboo undertakes to then inform you of the various stages of your order and in particular its dispatch.

Hiboo 6: Product Presentation

The Hiboo company undertakes to describe its products as precisely as possible in its descriptions and in the various sections of the website www.hiboo.be. If errors or omissions are found concerning these presentations or the description of the products, the Hiboo company cannot be held liable.

Photographs and illustrations are also not part of the contractual scope.

Hiboo 7: Delivery

Packages are shipped and delivered in one go to the address indicated by the customer when ordering on the Hiboo website. If the customer wishes to be delivered in several times, he will have to pay the sum of €110 excluding VAT per additional delivery beyond the first delivery.

The delivery times indicated on the site correspond to the average times observed for shipping and delivery, on working days and do not correspond to a contractual commitment.

The prices indicated on the site www.hiboo.be are indicated in euros, including VAT (All Taxes Included) and including transport costs for Belgium.

For the rest of Europe, the prices indicated on the site www.hiboo.be do not include transportation.

For consumers living in other geographical areas where delivery would be made by the Hiboo company, the prices displayed do not include VAT or shipping costs. Participation in shipping costs may be requested after selecting the product.

The rates for deliveries outside the areas where Hiboo offers free delivery are indicated when placing the order. For areas outside the European Union, taxes and customs fees may be claimed by the carrier (Hiboo 4).

The customer is responsible for the information (delivery address, name and telephone number) that he/she provides when placing his/her order. Hiboo cannot be held liable in the event that an error prevents or delays delivery.

Delivery takes place between 7:30 a.m. and 7:00 p.m. to the address indicated during the ordering process. This always takes place upon prior appointment.

The Buyer undertakes to be present on the scheduled delivery date. In the event of an unjustified absence not reported at least 24 hours in advance, the seller will be entitled to charge for a second delivery at a price of 110 euros excluding VAT. However, the Buyer may appoint a third party to receive the goods. In this case, the Buyer must confirm the identity of the third party but may not under any circumstances change the place of delivery unless expressly agreed by HIBOO.

Deliveries are made to the customer's building or home. The customer agrees to ensure that the delivery location is easily accessible. In the event of a delay in delivery, the customer will be informed by telephone or email. The price offered by HIBOO sprl for this service includes 45 minutes for unloading the equipment at the customer's premises and complete assembly of the bed (2 boxes, headboard and mattress). Any handling not included in the initial quote and any waiting time will be subject to additional invoicing of €30 per 15-minute period.

The assembly of the bed is provided by HIBOO. The customer undertakes to ensure that the assembly location is easily accessible and that the location has sufficient space to transport the various pieces of furniture (minimum dimensions 205cm x 140cm x 15 cm) to the indicated location. In the event of access difficulties or risk of damage related to the assembly of the furniture, the customer will take the necessary steps to ensure that the furniture is transported in the best possible conditions (elevator available on site or removal type freight elevator at the customer's expense). From the third floor, hiboo is entitled to ask the customer for a lift to make the delivery.

If the customer chooses to collect the equipment himself or through a third party of his choice from HIBOO's warehouses, transport, handling, loading and unloading are at his expense, risk and under his full responsibility. The collection and return of the equipment must take place on the day(s) and time(s) set in the contract. In agreement with HIBOO, the buyer can benefit from a reduction of 70 euros including VAT in the event of collection of the goods.

We advise the Buyer, upon receipt:

To check the conformity of the goods delivered in relation to the order,
To check that no damage has occurred during transport,
To mention any useful reservations on the transport receipt itself,
We recommend that the Buyer keeps the packaging in perfect condition.

Hiboo 8: Payment – ​​see our payment method

You can pay for your purchase by any means available on our website. We offer payment by credit or debit card (VISA and Mastercard), Paypal and prepayment. We reserve the right to offer less than all of our payment options. The account associated with your payment method will be charged at the time of ordering.

The customer fully authorizes Hiboo to use the payment card to pay for his order and that such payment means legally giving access to sufficient funds to cover all costs of the order. Hiboo cannot be held responsible for the fraudulent use of the payment method used. Invoices, order allocations and supporting documents must be provided in electronic form only. Hiboo reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and level of execution in the event of non-payment of any amount payable by the customer.

All payments will be processed through a secure data encryption system so that no information provided by the customer is intercepted by third parties. It is the customer's responsibility to save and print the payment invoice if they want to keep the details of the transaction. Hiboo retains full ownership of all products sold until payment is in full, including all applicable fees, taxes and mandatory contributions are received.

Hiboo 9: Right of withdrawal

In accordance with the law, you have a period of 14 working days following the date of receipt of your delivery or collection of your order to withdraw. You can exercise your right of withdrawal as soon as your sales contract is concluded. This is only valid for orders placed and concluded outside the store, i.e. on www.hiboo.be

In the case of a single order delivered in several installments, the period begins from receipt of the last item forming part of the same order.

Your right of withdrawal must be communicated by email: hello@hiboo.be

HIBOO will send you an acknowledgement of receipt in return to confirm that your withdrawal request has been taken into account.

Hiboo reserves the right to request photos before return. Products showing damage or signs of wear resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of these products, Hiboo may refuse the refund or reduce the amount refunded accordingly.

9.1 Conditions relating to the 60-night Extended Trial Offer for Mattresses

The “60 Nights” extended trial offer is limited to one use/exchange per customer and per order.

The "60 nights" extended trial offer is limited to the purchase of new products. Second-hand and clearance products are excluded from this offer.

The "60 nights" extended trial offer is only valid if a mattress protector is purchased from Hiboo and delivered no later than the day of mattress delivery . Mattress protectors purchased elsewhere are not eligible for this extended offer.

Mattresses purchased for hotel, bed and breakfast, guest house or other non-private and personal use do not benefit from the extended 60-night trial offer.

Hiboo offers an extended 60-day trial period, exclusively for its mattresses, whether purchased alone or included in the MINUIT pack. This trial period is an extension of the standard 14-day right of withdrawal, in accordance with Article L121-21 of the Consumer Code, bringing the total duration to 60 calendar days from the date of receipt of the mattress. It is important to note that the boxes and headboards included in the MINUIT pack remain subject to the standard 14-day withdrawal conditions.

During this trial period, the customer has the option to exchange or request a refund of the mattress. To do so, the request must be sent by email to hello@hiboo.be, accompanied by photos and the reason for the return.

To benefit from this offer, the mattress must be returned to us in a rigorous state of cleanliness, free of stains, and accompanied by the original order form or invoice.

See reasons for exclusions below. Article 9.2

Deadline for returning an item

You then have a maximum period of 14 days from the date of your withdrawal request to return the product to the HIBOO warehouse.

Refund of returned orders

If you exercise your right of withdrawal, HIBOO will refund the products and the initial delivery costs or collection costs. However, additional costs related to a more expensive delivery method than the standard method will not be refunded.

For mattresses covered by the 60-day trial offer, the refund amount will be specifically calculated based on the method of purchase of the mattress, whether purchased individually or in combination with the MINUIT pack. As part of the MINUIT pack offer, the trade-in value of the mattress is calculated based on the table below.

If the customer benefits from any discount on the purchase, the price indicated above may be revised proportionally.

Unless otherwise agreed, reimbursement is always made using the original payment method used at the time of purchase.

The refund of the products will be made within 72 hours from the date on which HIBOO has recovered the goods.

9.2 Return conditions in the event of exercising the right of withdrawal or the offer extended by 60 nights:

The cost of returning the product is your responsibility.

If you want a collection by HIBOO, you must pay in advance the transport costs of the product to the nearest HIBOO depot. The collection and return costs amount to €75.

You can also drop off your product yourself free of charge by appointment, at the depot provided by Hiboo, with your proof of purchase (order confirmation email, invoice or delivery note).

You are invited to take all measures and, where appropriate, all insurance to cover the possible destruction, partial or total, of the returned goods until they are handed over to HIBOO.

Products returned incomplete or received after 14 days from the exercise of the right of withdrawal, damaged, soiled, damaged will not be refunded and will remain at the disposal of the Buyer. All items must be returned in packaging.

Exceptions:

The right of withdrawal for mattresses, box springs and related textiles applies exclusively to items of standard sizes: 70×200, 80×200, 90×200, 140×200, 160×200 and 180×200.

If the purchase concerns personalized products, the Buyer does not benefit from this right of withdrawal. Thus, in accordance with the legislation, withdrawal is excluded for contracts for the supply of goods that are clearly personalized or made to the consumer's specifications. In particular, items that are excluded from the right of withdrawal are custom-made items (specific sizes, colors or specific textiles, etc.), non-standard measurements (80×190, 120×190, 150×190, 160×190, 200×200 or others, see standard sizes above), with specific additions or modifications for bedding (specific sizes or thicknesses, zippers, etc.).

The right of withdrawal and in-store returns do not apply to textile products, including sheets, duvet covers, mattress protectors, pillowcases, as well as duvets and pillows, if these items have been removed from their original packaging, for reasons of health protection or hygiene.

Hiboo 10: Cookies Policy

The Client expressly authorizes Hiboo to place a file called a “cookie” on the client’s hard drive.

This "cookie" is intended to facilitate the collection of statistics, customer recognition and identification in the "my account" area of ​​the Hiboo company website. A cookie does not allow us to identify you by name. Generally speaking, it records information relating to your browsing on our site, which we can read during your subsequent visits.

This data is strictly intended for internal use by Hiboo and is not communicated to third parties.

You can object to the use of cookies by configuring your browser.

Some cookies are advertising cookies that allow us to record the products viewed in order to present you with advertising banners in line with your interest within a maximum period of 90 days.

Hiboo 11: Responsibility

The Hiboo company has only an obligation of means in all stages of access to the site, visit, entry of forms, placing of orders, preparation of orders, delivery of orders, returns of products and reimbursements of orders to be reimbursed.

Hiboo cannot be held liable for any inconvenience or damage inherent in the use of the Internet and outside the precautions taken by the company.

Hiboo cannot be held liable for any cases of force majeure, external intrusion or presence of computer viruses.

Hiboo 12: Intellectual Property

The Site and its components (brands, logos, graphics, photographs, animations, videos, music, texts, etc.) constitute the property of Hiboo. They are protected by intellectual property rights (in particular copyright, design rights, trademark rights, etc.) and may therefore not be reproduced, used or distributed without the prior written authorization of Hiboo or, where applicable, of the rights holder concerned, under penalty of constituting an offense of copyright and/or design and/or trademark infringement, punishable by three months to three years and a fine of 100 to 100,000 euros or one of these penalties only.

Hiboo hereby grants the User a non-exclusive, non-transferable license, for an indefinite period and revocable at any time without giving any reason, to access, display and download the content of the Site solely for the purposes of display. The User may also print a copy of the content displayed on the Site for their personal needs, provided that they do not alter the content of the Site in any way and that they retain all mentions of authorship and origin of the Site. Reproduction is therefore only authorized for strictly private purposes within the meaning of Article XI.190 5° of the Code of Economic Law.

Any use of the Site and its components not covered by this article is strictly prohibited.

Hiboo 13: Warranty Conditions

Products sold by the Hiboo company are subject to a 2-year warranty on all material and manufacturing defects.

The benefit of the warranty must be requested by the buyer of the product, having the invoice of the order. In order to benefit from the warranty, the product must be able to be returned in good condition and clean.
In the event that a manufacturing defect is proven, Hiboo will replace the defective product with a new product at its own expense.

The warranty period begins on the date of receipt of the goods indicated on the invoice or, where applicable, on the delivery note. This warranty applies only to goods; services are excluded.

MATTRESS - 10 year warranty

The warranty covers the core of the mattress against any abnormal sagging or premature deformation under normal conditions of use, on a suitable bed base in good condition.

Please note that the adaptation phase to the shape of your body may result in a slight settling of less than 20% of the filling materials. This is normal and cannot be covered by the warranty.

BED BOXES - 10 year warranty

Fixed bed bases, i.e. excluding electric and manual bed bases, are guaranteed for life against any manufacturing defect during normal use. This guarantee does not apply to the following parts: ball joints, slat clips, mattress stops, sliders, blocks, screw threads, feet, slats, headboards and clips, upholstery ticking.

Electric bed bases are guaranteed for two years against any manufacturing defect provided they are used normally.

CONDITIONS OF APPLICATION AND EXCLUSIONS FOR WARRANTIES ON BED BASE AND MATTRESSES

Under no circumstances does the warranty cover deterioration that may result from a lack of maintenance, use of force, an accident, an abnormal phenomenon of humidity or heat (no mold, no trace of humidity, or deterioration such as burning), attempted repairs or other transformations made to the product (sawing, drilling, etc.), nor deterioration of the covering fabrics, sewing thread or any other element whose good condition is linked to the conditions of use.

To benefit from the guarantee, the product must be returned to us in a rigorous state of cleanliness, free of stains, and accompanied by the original purchase order or invoice. We recommend the use of our Hiboo mattress protector to ensure the cleanliness of your mattress throughout its lifespan.

By this guarantee, we undertake to exchange a similar or equivalent product, or to repair the mattress or box spring recognized as defective. The delivery service will be billed as indicated above.

To benefit from the warranty, the following conditions must also be met:
– The mattress must be placed on a suitable base in good condition.
– Spring and micro spring mattresses must not be used on slatted bases with a space between each slat greater than 5 cm.
– It must be protected by a waterproof mattress protector.
– It should never be placed directly on the ground or on an unventilated surface.
– You must turn your mattress at least twice a month (head/feet and front/back), unless otherwise indicated.
– The warranty label located on the edge of the mattress must not be removed under any circumstances.

Any exchange or repair will not have the effect of extending the duration of the warranty.

There is nevertheless a principle of obsolescence (not applicable to fixed bed bases guaranteed for 10 years and excluding the exclusions defined above) to assess the residual value of the product which is applied according to the details below:

• From 0 to 2 years: 100% of the value
• After 2 years: 80% of the value
• After 3 years: 60% of the value
• After 5 years: 40% of the value
• After 7 years: 20% of the value

Hiboo 14: Dispute handling

The validity, interpretation and/or execution of the T&Cs are subject to Belgian law, to the fullest extent permitted by the applicable rules of private international law.

In the event of a dispute relating to the validity, interpretation or execution of the T&Cs, the Courts and Tribunals of the judicial district of Brussels shall have exclusive jurisdiction, to the fullest extent permitted by the applicable rules of private international law.

Before taking any steps aimed at the judicial resolution of a dispute, the Buyer and Hiboo undertake to attempt to resolve it amicably. To this end, they shall first contact each other, before resorting, where appropriate, to mediation, arbitration, or any other alternative dispute resolution method.

Hiboo 15: Personal data

The Hiboo company reserves the right, thanks to the cookie referred to in Hiboo 11, to collect data relating to users of the site in a nominative manner.

Hiboo is the owner of the data collected and reserves the right to use and transfer it.

In all cases, and in accordance with law n°78-17 of January 6, 1978, any user or customer of the site may at any time oppose the commercial use of said data and also benefits from a right of access, rectification and deletion of data concerning them.

Hiboo 16: Modification of the general conditions of sale

Hiboo reserves the right to modify and update, at any time, by notifying Users via the Site, these T&Cs, the T&Cs, the Charter, and the Cookie Policy, access to the Site and its content. All of these modifications are binding on Users each time they access the Site.

In the event of any discrepancies between the language versions of these T&Cs, the T&Cs, the Charter or the Cookie Policy, the French language version shall prevail.

In the event that any term of the general conditions of sale and use is considered illegal or unenforceable by a court decision, the other provisions will remain in force.
